The limits of the freedom of speech : is it possible to say everything? : analysis of the jurisprudential trends of the Polish Constitutional Tribunal, the Supreme Court, the Courts of General Jurisdiction and the European Court of Human Rights

The article indicates the courts' tendency to resolve conflicts of constitutional rights and freedoms. Moreover, the legal framework for the admissibility of limiting the freedom of speech was established. Furthermore, the SLAPP phenomenon was characterized, which is a considered threat to the development of demoralization and public debate. The purpose of the article is to highlight the opportunities and threats facing a democratic society that does not exist without pluralism, tolerance and inclusiveness.

W artykule wskazano tendencje sądów do rozstrzygania kolizji praw i wolności konstytucyjnych oraz ustalono ramy prawnej dopuszczalności ograniczania wolności wypowiedzi. Scharakteryzowano relację między prawem do krytyki a omawianą wolnością konstytucyjną. Przybliżono zjawisko SLAPP, które stanowi zagrożenie dla rozwoju debaty publicznej. Celem opracowania jest zwrócenie uwagi na możliwości i zagrożenia, jakie stoją przed społeczeństwem demokratycznym, które nie istnieje bez pluralizmu, otwartości i tolerancji.
