Does Poland need the post of the vice-president?

Tragic events that took place on 10th of April 2010 were not only a great shock for the whole Polish nation, but also an important test for the efficiency of functioning of the Polish country. For the first time since the Constitution have been passed, the regulations on the substitute of the President due to his death were used. This events exposed the inexcellence of the solutions applied in the text of the Constitution. At the beginning article presents the regulations on the substitute of the head of state from different countries. Furthermore, the article shows criticism on present solutions on the substitute of the President in the Polish Constitution and finally proposes the possibility to implement the position of the Vice-President in Polish legal system as one of the possible solutions to improve the rules of the Polish Constitution in this aspect.

Tragiczne zdarzenia z 10 kwietnia 2010 r. były nie tylko wielkim wstrząsem dla całego Narodu, ale także stanowiły ważny test dla sprawności funkcjonowania państwa. Pierwszy raz od uchwalenia obecnie obowiązującej Konstytucji doszło do zastosowania przepisów odnoszących się do zastępstwa głowy państwa w wyniku śmierci Prezydenta. Zdarzenia te uwidoczniły niedoskonałości rozwiązań zastosowanych w tekście Konstytucji. Analiza zagadnienia rozpoczyna się od zaprezentowania istniejących na świecie modeli zastępstwa głowy państwa. W dalszej części stanowi krytyczną ocenę obecnych rozwiązań odnoszących się do omawianego zagadnienia, by następnie, poszukując alternatywy dla istniejących niedoskonałości, zaprezentować możliwość wprowadzenia w Polsce urzędu wiceprezydenta jako jednego z możliwych rozwiązań udoskonalenia postanowień Konstytucji w omawianym zakresie.
