Implementacja w polskim porządku prawnym dyrektywy o europejskim nakazie dochodzenia

Artykuł przedstawia nowelizację kodeksu postępowania karnego dostosowującą przepisy polskiej procedury do wymogów stawianych przez dyrektywę Unii Europejskiej o europejskim nakazie dochodzeniowym. Opisane zostaną przesłanki wydania nakazu przez polskie organy ścigania oraz postępowanie przed polskimi organami wymiaru sprawiedliwości w sprawie nakazu wydanego w innych państwach UE.

The article presents a review of the amendment to the Code of Criminal Procedure adapting the provisions to the Polish procedure the requirements set by the European Union directive about the European Investigation Order. There are presented the reasons for issuing the order by the Polish law enforcement authorities and the proceedings before the Polish judicial authorities regarding the order issued in other EU countries.
