Perspectives of law and organisation of conservation administration on the 100th anniversary of establishing independent monument protection services in Poland

Przedmiotem prowadzonych rozważań są perspektywy prawa i organizacji administracji konserwatorskiej w 100-lecie powstania niepodległych służb ochrony zabytków w Polsce. Autor w pierwszej części swoich rozważań koncentruje się na okolicznościach wydania dekretu Rady Regencyjnej z dnia 31 października 1918 r. o opiece nad zabytkami sztuki i kultury. W dalszej części zaprezentowane zostały zmiany obowiązującego prawa ochrony zabytków od 1918 r. aż do dnia dzisiejszego. Istotnym elementem opracowania jest zaakcentowanie roli służb ochrony zabytków w realizacji zadań ochrony zabytków. W ostatniej części opracowania zaprezentowane zostały sugestie o charakterze de lege ferenda w zakresie zmian w polskim systemie ochrony zabytków.

The current considerations address the perspectives of law and organisation of conservation administration on the 100th anniversary of establishing independent monument protection services in Poland. In the fi rst part of his considerations, the Author concentrates on the circumstances in which the Regency Council issued its decree on October 31, 1918 on the protection of art and culture monuments. Changes in the law on monument protection since the year 1918 until the present day have been presented further on. A signifi cant element of the study is emphasising the role of conservation services in realising monument protection tasks. The last part of the study presents de lege ferenda suggestions concerning changes in the Polish monument protection system.
