Issues connected with a headcount of trade union bodies
Headcount status of trade union bodies has crucial meaning for the functioning of collective employment relationships. Practical significance is important in regard to which organization is entitled by law to decretive eligibility. The amendment to the act of 5.7.2018, amending the act on trade unions and other acts, introduced significant changes regarding verification of members of that organization. This issue is complicated in nature, the matter regards both legally substantive and procedural regulations. They directly influence both the status of trade unions and employers (e.g. during negotiations or group redundancy). In the present article the author – while being governed by the directive sine ira et studio – shows various aspects of the amended article 251 of the act of 23.5.1991, on trade unions.
