Institutional lease leading to acquisition of ownership (Part 2)

Artykuł jest kontynuacją rozważań o najmie instytucjonalnym z dojściem do własności jako nowego typu najmu lokalu mieszkalnych w prawie polskim. Autorka analizuje wykonanie wzajemnych zobowiązań stron wynikających z umowy najmu, takich jak zobowiązanie do zawarcia umowy przenoszącej własność lokalu na najemcę. W opracowaniu omówiono także ustawowe przyczyny wypowiedzenia najmu i skutki wypowiedzenia, przede wszystkim w zakresie rozliczeń między stronami.

The article continues the discussion on institutional lease leading to acquisition of ownership as a new type of the residential premises lease in Polish law. The author analyses the execution of the parties’ mutual obligations arising from the contract, such as the obligation to conclude a contract on transfer of ownership of the premise to the tenant. The article discusses also the statutory reasons for termination of the lease and its legal consequences, especially the financial settlements between the former tenant and landlord.
